Home Meal App respects the intellectual property rights of others and expects users to do the same. This DMCA Policy outlines our procedures for responding to copyright infringement claims.

1. Copyright Infringement Notification

1.1 Filing a DMCA Notice

If you believe content on our Platform infringes your copyright, submit a DMCA notice containing:

  1. Physical or electronic signature of the copyright owner or authorized agent

  2. Identification of copyrighted work claimed to be infringed:

    • Description of the work
    • If multiple works, a representative list
    • Copyright registration number (if available)
  3. Identification of infringing material:

    • URL or specific location on Platform
    • Username of uploader (if known)
    • Screenshots showing infringement
    • Detailed description to locate material
  4. Your contact information:

  5. Good faith statement:

    • "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  6. Accuracy statement under penalty of perjury:

    • "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."

1.3 What Happens After Filing

Within 24-48 hours:

  1. We acknowledge receipt of your notice
  2. We review the notice for completeness
  3. If valid, we remove or disable access to allegedly infringing content
  4. We notify the user who posted the content
  5. User has the right to file a counter-notice

Note: We may not respond to incomplete notices. Ensure all required information is included.

2. Counter-Notification

2.1 If Your Content Was Removed

If you believe your content was removed by mistake or misidentification, you may file a counter-notice.

Required Information:

  1. Your physical or electronic signature

  2. Identification of removed material:

    • Description of content
    • Location before removal (URL)
  3. Good faith statement:

    • "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification."
  4. Consent to jurisdiction:

    • "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located (or [Your Jurisdiction] if address is outside the United States), and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."

2.2 Where to Send Counter-Notice

Send to the same DMCA Agent contact information above.

2.3 What Happens After Counter-Notice

Within 10-14 business days:

  1. We forward your counter-notice to the original complainant
  2. Complainant has 10-14 business days to file a court action
  3. If no court action filed, we may restore your content
  4. If court action filed, content remains removed pending court decision

Note: Filing a counter-notice has legal consequences. Consider consulting an attorney.

3. Repeat Infringer Policy

3.1 Three-Strike Policy

First Violation:

  • Content removed
  • Warning issued
  • Educational notice sent

Second Violation:

  • Content removed
  • Temporary suspension (30 days)
  • Final warning

Third Violation:

  • Permanent account termination
  • All content removed
  • Cannot create new accounts

3.2 Serious Violations

For egregious violations (mass piracy, counterfeit goods, etc.):

  • Immediate permanent termination
  • No prior warnings required
  • Legal action may be pursued

3.3 Account Reinstatement

After termination for copyright violations:

  • Must wait minimum 6 months
  • Must demonstrate understanding of copyright laws
  • Must provide assurance of future compliance
  • Reinstatement at our sole discretion

4. Fair Use Considerations

4.1 Fair Use Defense

Not all uses of copyrighted material constitute infringement. Fair use may apply for:

  • Commentary and criticism
  • News reporting
  • Teaching and education
  • Research and scholarship
  • Parody

Factors considered:

  1. Purpose and character of use (commercial vs. non-commercial)
  2. Nature of copyrighted work
  3. Amount and substantiality used
  4. Effect on market value

4.2 Platform's Position

  • We do not make fair use determinations
  • Fair use is a legal defense in court
  • If you believe your use is fair use, include explanation in counter-notice
  • Courts ultimately decide fair use questions

4.3 User Responsibility

Before posting content:

  • Ensure you own it or have permission
  • Consider whether fair use applies

5. Types of Copyrightable Content

5.1 Content Protected by Copyright

On our Platform:

  • Food photos (unless you took them)
  • Recipe text (if creative expression, not just ingredient lists)
  • Menu descriptions
  • Business logos and branding
  • Marketing materials
  • Music in background of videos
  • Artwork or graphics
  • Written reviews (belong to author)

5.2 Content NOT Protected

Generally not copyrightable:

  • Ideas or concepts
  • Simple ingredient lists
  • Titles and short phrases
  • Recipes as mere lists of ingredients
  • Facts and data
  • Public domain works
  • Government works

Note: While basic recipes aren't copyrightable, creative descriptions and photos are.
